Part 1 · Website Terms of Service
These Website Terms of Service ("Terms") govern your access to and use of stradanaples.com and your submission of reservation requests. Our Privacy Policy is incorporated by reference. Please read these Terms carefully.
1. Acceptance of these Terms
By accessing or using stradanaples.com, or by submitting a reservation request, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the site. When you submit a request, we may ask you to affirmatively accept these Terms (for example, by checking a box); doing so confirms your agreement.
2. Who may use the site
You must be at least 18 years old and able to form a binding contract to submit a reservation request or transact with us. The site is intended for adults. Renting a vehicle carries its own, higher age and eligibility requirements (see Part 2).
3. These Terms and your Rental Agreement
These Terms cover your use of the website and the reservation-request process only. They do not create a rental. Any rental is governed by the separate written Rental Agreement you sign at the time of rental. If these Terms ever conflict with your Rental Agreement, the Rental Agreement controls for everything concerning the vehicle and the rental.
4. Reservation requests, pricing, and availability
Vehicle listings, rates, and availability shown on the site are an invitation to inquire, not an offer. When you submit a request, you are making an offer to rent; no reservation, hold, or contract exists until we confirm it in writing.
Rates, fees, deposit and insurance requirements, mileage allowances, and vehicle availability are subject to change, substitution, and verification. Published rates reflect base-season pricing and may differ from your final quote. We may decline or cancel any request at our discretion, including for eligibility, availability, or suspected fraud.
5. License to use the site
We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the site for your personal, non-commercial purpose of learning about and requesting our vehicles. All other rights are reserved.
6. Intellectual property
The site and its content — including vehicle photography, text, graphics, logos, and the Strada Exotics name and marks — are owned by or licensed to us and protected by copyright, trademark, and other laws. You may not copy, reproduce, scrape, frame, republish, or create derivative works from any part of the site without our written permission.
7. Acceptable use
When using the site, you agree not to:
- Submit false, misleading, or another person's information
- Use bots, scrapers, or automated means to access or collect data from the site
- Interfere with, disrupt, or attempt to gain unauthorized access to the site or its systems
- Use the site for any unlawful purpose or in violation of these Terms
- Infringe the rights of others or misappropriate our content or marks
8. Feedback
If you send us ideas, suggestions, or feedback, you grant us a perpetual, royalty-free right to use them without restriction or compensation. The site is not a platform for posting your own public content.
9. Third-party links and services
The site may link to third-party websites or services, such as maps or messaging. We do not control and are not responsible for their content, practices, or availability, and a link is not an endorsement. Your use of third-party services is governed by their own terms.
10. Electronic communications
By using the site or contacting us, you consent to transact and communicate with us electronically, and you agree that electronic agreements, notices, disclosures, and records satisfy any legal requirement that they be in writing. Consent to receive marketing email or text messages is separate and optional, is described in our Privacy Policy, and may be withdrawn at any time.
11. Disclaimer of warranties
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT VEHICLE LISTINGS, PRICING, OR AVAILABILITY ARE ACCURATE, CURRENT, OR COMPLETE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STRADA EXOTICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR THE RESERVATION-REQUEST PROCESS, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This section applies only to your use of the website and the request process. It does not limit liability for the rental itself (which your Rental Agreement and the applicable insurance address), for personal injury, for gross negligence or willful misconduct, for fraud, or for anything that cannot be limited under the Florida Deceptive and Unfair Trade Practices Act or other applicable law.
13. Indemnification
You agree to indemnify and hold Strada Exotics harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.
14. Governing law, venue, and waiver of jury trial and class actions
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to the site or these Terms must be brought exclusively in the state or federal courts located in Collier County, Florida (or the U.S. District Court for the Middle District of Florida, Fort Myers Division), and you consent to their jurisdiction.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND STRADA EXOTICS EACH WAIVE THE RIGHT TO A JURY TRIAL, AND AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.
15. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted with a revised "Last updated" date, and we will give reasonable notice of material changes. Your continued use of the site after changes take effect means you accept the updated Terms.
16. General
If any provision of these Terms is held unenforceable, the rest remain in effect. We may assign these Terms, for example in a sale of the business; you may not assign them without our consent. Neither party is liable for failure to perform due to events beyond its reasonable control, including weather, hurricanes, natural disasters, or government action. Our failure to enforce a provision is not a waiver of it. These Terms and the policies they reference are the entire agreement between you and us regarding the site.
17. Accessibility
We want everyone to be able to use our site. We are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA and continue to improve accessibility over time. Part 2 · Rental Terms (Summary)
This summary explains the key terms that apply when you rent a vehicle from us, so there are no surprises. It is provided for convenience only. The complete, binding terms are set out in the written Rental Agreement you sign at the time of rental, which controls if anything here differs from it.
Driver eligibility
To rent, you must be at least 21 (25 for select supercars), hold a valid, unexpired driver's license, and meet our insurance and deposit requirements. U.S. renters must have held a license for at least one year. International renters are welcome with a passport and a valid home-country license; if your license is not in English, an International Driving Permit — which only translates your license — must accompany it. Drivers under 25 may be subject to a young-driver surcharge. We inspect and verify each driver's license, and we may decline any rental.
Authorized drivers
Only drivers we have approved and listed on the Rental Agreement may operate the vehicle. Allowing an unlisted person to drive is a serious breach that voids any damage waiver and may forfeit insurance coverage.
Insurance
Florida is a no-fault state with minimum coverage requirements, and we maintain the insurance the law requires. You must carry valid insurance that applies to the rental, and you should confirm it before you book — personal auto policies and credit-card rental benefits commonly exclude exotic and high-value vehicles, so you may need a supplemental protection package from us.
Your signed Rental Agreement designates your insurance as primary in the form Florida law requires (Fla. Stat. §627.7263), stating: "The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes."
Optional protection (CDW / LDW and supplemental liability)
We offer optional protection products, including a Collision/Loss Damage Waiver (CDW/LDW) and Supplemental Liability Protection. These are optional and are NOT insurance. A damage waiver limits your financial responsibility for covered damage to the vehicle, subject to its terms; it does not apply if you breach the Rental Agreement (for example, a prohibited use or an unauthorized driver). These products may duplicate coverage you already have. Prices, conditions, and exclusions are provided before you buy.
Owner liability (Graves Amendment)
As the vehicle's owner and a company in the business of renting vehicles, we are not vicariously liable for your or an authorized driver's operation of the vehicle, as provided by the federal Graves Amendment (49 U.S.C. §30106). You are responsible for how the vehicle is operated during your rental.
Security deposit and authorization hold
A refundable security deposit or pre-authorization hold is placed on a major credit card in the renter's name for the rental period; the amount is listed for each vehicle and confirmed before your rental. A hold is not a charge, but it reduces your available credit. We release it after the vehicle is returned in its original condition, less any amounts you owe (such as damage, fuel, tolls, citations, or fees). How quickly the hold clears is determined by your bank. Debit cards are not accepted for the deposit.
Fees and pricing
We aim to present all-in pricing. Charges may include the rental rate, the Florida rental-car surcharge, any young-driver surcharge, optional protection products, mileage overage, fuel and cleaning, delivery, and late-return or extension fees. All applicable fees are disclosed before you are charged.
Tolls, citations, and administrative fees
You are responsible for all tolls, parking, traffic, and red-light-camera charges incurred during your rental, plus a reasonable administrative fee per event. You authorize us to pay such charges and recover them from your card or deposit, and to provide your information to tolling and citation authorities as the law allows.
Prohibited uses
To protect you and the vehicle, the following are prohibited:
- Racing, track or timed events, speed contests, or track days
- Driving under the influence of alcohol or drugs
- Off-road driving or driving on unpaved surfaces
- Towing, pushing, or carrying loads beyond the vehicle's rating
- Any illegal, reckless, or stunt use
- Transporting people or property for hire
- Allowing unauthorized or unlisted drivers to operate the vehicle
- Sub-leasing or re-renting the vehicle
- Smoking, vaping, or transporting pets without approval
- Taking the vehicle outside the permitted area without our written consent
Any prohibited use voids any damage waiver, may forfeit insurance coverage, makes you fully responsible for all loss, damage, and claims, and allows us to repossess the vehicle.
Mileage and geographic limits
Each rental includes a daily mileage allowance, with a per-mile rate beyond it, confirmed in your quote. Vehicles must remain within the geographic area stated in your Rental Agreement.
GPS and telematics
Our vehicles contain GPS and telematics systems. We may monitor location and vehicle data for theft prevention and recovery, fleet management, safety, and to enforce the Rental Agreement (such as prohibited-use and geographic limits). By renting, you consent to this. We handle the data as described in our Privacy Policy.
Condition, return, and fuel
Vehicles are delivered detailed and fueled and must be returned at the agreed time, in the same condition, with the same fuel level or with prepaid fuel. Late returns, excessive cleaning, and missing items may incur charges.
Damage, loss, and your responsibility
Unless covered by a valid damage waiver you purchased, you are responsible for the full cost of repair or replacement for damage to, or loss or theft of, the vehicle during your rental, plus loss of use (the vehicle's rental value while it is being repaired, even if we do not rent a replacement), any diminished value, towing and storage, and a reasonable administrative fee. We provide documentation of such charges on request.
Cancellations
We offer flexible cancellation with advance notice; the specific terms depend on the vehicle and dates and are shared when you book. Please tell us as early as you can if your plans change.
Personal property
We are not responsible for personal property left in or lost from the vehicle. Please take your belongings with you.
